Glenn Greenwald v. Lawrence Lessig: A Debate on Elena Kagan's Supreme Court Nomination
 
If confirmed, the fifty-year-old Elena Kagan would be the Court's youngest member. She would become the fourth female Supreme Court justice in US history and the third on the Court's current bench. She would also be the first justice in nearly four decades without any prior judicial experience. Kagan's nomination has divided progressives in part because so little is known about her judicial views. Her nomination sparked a heated debate between two noted legal commentators: Harvard Law professor Lawrence Lessig and constitutional law attorney and Salon blogger, Glenn Greenwald. Greenwald first appeared on Democracy Now! last month making his case against Kagan's nomination. On Monday, he was interviewed on The Rachel Maddow Show. Right after Greenwald, Rachel Maddow interviewed Lawrence Lessig, who criticized some of Greenwald's comments. This led to them both penning articles online yesterday criticizing each other and defending their position on Kagan's nomination.

TXU Energy Solar Program

New solar-energy program for Dallas-Fort Worth homes sees big response

Mary Ellen and Ray Kramer considered putting solar photovoltaic panels on the roof of their 2,800-square-foot home two years ago. But the price tag of $30,000 to $40,000 was cost-prohibitive, Mary Ellen said.

The retired Pantego couple felt that they might not "be here long enough" to recoup such a large investment through savings on their electric bill, she said.

But that was before TXU Energy announced in February that it is pairing up with a California-based company, SolarCity, to launch a groundbreaking residential solar energy program that doesn't require homeowners to put up any money in advance. There is no upfront cost for installation, and homeowners can instead make monthly lease payments on the solar panels. The savings on electric bills generally can be expected to exceed the monthly lease cost, TXU Energy and SolarCity officials say.

Ms. Mavis Knight, member of the SBOE will share her experiences and challenges in working with the Board and, most importantly, tell our membership what we can do to help change the composition of the State Board of Education, so that it will no longer be the punch line of late night comedians' jokes, but will instead allow our State's children to receive a quality, fact-based education. 
 
The nation's attention was on the SBOE for three days this year as they debated the standards for Texas social studies textbooks.  The Republican majority succeeded in giving gun rights the same importance as free speech rights, strengthening references to Christianity and emphasizing "the dangers of overregulation" in textbooks.  The Republican majority also voted to de-emphasize Thomas Jefferson, FDR and the establishment clause to the Bill of Rights. Ms. Knight proposed an amendment to the proceedings which would have required Texas students to be taught the reasons the Founding Fathers "protected religious Freedom in America by barring governments from promoting or disfavoring any particular religion over all others."

Is "Left" becoming a four-letter word?



You'd think so lately with each day bringing more news of unconscionable conservative tilts in the electorate, while the drumbeat of the Democrats' supposed death march to November gets ever louder.
For example, a Wall Street Journal/NBC News survey released this week found that a majority of Americans supported Arizona's hostile new immigration law, even as most allowed that the law is likely to lead to more discrimination against legal immigrants. Apparently, for some, there is an acceptable level of collateral damage.

A May 7 Gallup poll found that 42 percent of people wanted a Supreme Court nominee who would make the court more conservative, as opposed to only 27 percent who wanted a nominee who would make it more liberal. That was before Elena Kagan was nominated. Afterward, 40 percent rated her as a good or excellent choice, but that was the lowest such rating in recent history, even 4 percentage points lower than Harriet Miers's.

Facebook launches its 'Congress on Facebook' page today (facebook.com/congress). The page will highlight innovative uses of Facebook by members of Congress, list members' official pages and communicate news and information about Facebook and Congress. A 'Facebook and Government' page (facebook.com/government) showcases innovative uses of the social network by departments, and provides news and information of interest to agencies. More than 33 federal agencies have signed an agreement Facebook negotiated with the U.S. government in 2009 that allows agencies to have official Facebook pages. Agencies have launched more than 400 Facebook pages, with millions of fans.

Everything's bigger in Texas, like a $640 parking ticket



Tweed Clark stopped briefly at the Arlington Municipal Court to pay her daughter's $250 speeding ticket. So, how did Clark end up with a $640 parking violation of her own?
Clark admits that she parked in a yellow-striped space next to a handicap space for a few minutes March 8 but said she never saw a "no parking" sign until after an officer pointed it out to her while writing the ticket.
In Arlington, the fine for blocking access to a handicap parking space - the violation for which Clark was cited - is the same as for illegally parking

Follow up to postings on the Gulf Coast oil spill, additional timely resources from NOAA:

NOAA IncidentNews - "Under the National Contingency Plan, NOAA has responsibility for providing scientific support to the Federal On-Scene Commander (FOSC) for oil and hazardous material spills, and it is primarily ERD that provides that support. NOAA may also be activated under the National Response Plan Emergency Support Function 10 to support the coordinated federal response to incidents of national significance involving release of dangerous contaminants. To support these mandates, ERD provides 24-hour, seven-day-a-week response to spill events. NOAA Scientific Support Coordinators (SSCs), stationed in major port cities around the U.S., coordinate scientific information and provide critical information to FOSCs during emergencies. A multidisciplinary team of ERD scientists, including oceanographers, modelers, biologists, chemists, and geologists, is based in Seattle and supports the SSCs during spill events, as well as in drills, exercises, and contingency planning. ERD SSCs are strategically located around the country, often within U.S. Coast Guard (USCG) offices, providing local services to a range of users in public and private sectors."

Dan Froomkin: "National Oceanic & Atmospheric Administration officials last fall warned the Department of Interior, which regulates offshore oil drilling, that it was dramatically underestimating the frequency of offshore oil spills and was dangerously understating the risk and impacts a major spill would have on coastal residents. NOAA is the nation's lead ocean resource agency, and the warnings came in its response to a draft of the Obama Administration's offshore oil drilling plans. The comments were Web-published in October by the whistle-blowing group, Public Employees for Environmental Responsibility (PEER). But NOAA's views were largely brushed aside as Obama went ahead and announced on March 31 that he would open vast swaths of American coastal waters to offshore drilling -- a plan now very much in doubt as a blown-out BP well in the Gulf of Mexico spews out an estimated 200,000 gallons of oil daily, for the 13th straight day."

On Saturday, voters across the 26th Congressional District turned out and ousted mayors and city council members who simply don't believe there is a problem with natural gas drilling here in the Barnett Shale.
 
One of those elected officials voted out was Flower Mound Mayor Jody Smith. She had the endorsement of my opponent, Congressman Michael Burgess. Burgess called Smith "a true representative" leader for Flower Mound in his endorsement press release.

 
Why would Congressman Burgess call Jody Smith a true representative leader for the city when she ignored 3,000 Flower Mound citizens who asked the town council to impose a drilling moratorium?
 
Because he's in the pockets of oil and gas interests in Washington. The oil and gas industry is one of the top three contributors to his campaign!
 
He's voted against tax incentives for alternative energy development (HR 6049, 05/21/2008) and against renewable energy standards (HR 3221, H. Amdt. 748, 08/04/2007), and he has voted time and again to side with Big Oil and gas companies against Texas consumers--just like he did when he endorsed Jody Smith.
 
Saturday's election wasn't just a referendum against Mayor Smith or gas drilling in our area: it was a referendum against Michael Burgess and his oil-soaked voting record of putting petrochemicals above people.
